Business Terms of Service

1. The Service

Eazistamp provides a white-label digital loyalty stamp card platform. Eazistamp S.L. grants the business a non-exclusive, non-transferable licence to use the platform during the subscription period.

2. Accounts and Eligibility

You must be at least 18 years old and have authority to bind your business to these terms. You are responsible for all activity that occurs under your account. You must keep your account credentials secure and notify us immediately of any unauthorised access.

3. Subscription and Payment

• Free plan (€0): 1 location, limited to 50 active customers
• Starter plan (€18/month, or €15/month billed annually): 1 location, unlimited customers
• Pro plan (€42/month, or €35/month billed annually): up to 10 locations, unlimited customers
• Enterprise plan: unlimited locations and customers; custom pricing, arranged directly with us — no self-serve checkout
• New accounts get a 14-day free trial with full Starter-level access. No payment card is required to start the trial. If you don't subscribe before the trial ends, your account is not charged and is not suspended — it simply continues on the Free plan (existing data is kept; if you're over the Free plan's limits, you won't be able to add further locations or customers until you subscribe or reduce usage)
• All prices are exclusive of VAT/IVA. Applicable tax will be added at checkout
• Failed payments: a 7-day grace period applies before access restriction; we will attempt to notify you by email

4. Acceptable Use

You must not use Eazistamp to:

• Run loyalty programs for illegal products or services
• Mislead or defraud your customers
• Collect data beyond what is necessary for your loyalty program
• Resell or sublicense access to the platform

5. Your Data and Your Customers' Data

You remain the data controller for your end customers' personal data. See the Data Processing Agreement for full details. You are responsible for obtaining any consents required from your customers under applicable law.

6. Content You Upload

By uploading any logo, image, branding asset, or other content ("Content") to the Eazistamp platform, you represent and warrant that: (a) you own all right, title, and interest in the Content, or hold all necessary licenses, rights, consents, and permissions to upload, display, and distribute it through Eazistamp, including in customer-facing digital loyalty cards and Apple Wallet / Google Wallet passes; (b) the Content does not infringe, misappropriate, or violate any third party's intellectual property, privacy, or publicity rights; (c) the Content complies with all applicable laws in the jurisdictions where your business operates and where your customers are located; and (d) you have obtained any consents required from individuals depicted in the Content.

You may not upload, and Eazistamp may remove or refuse to publish, Content that:

• is illegal under applicable law, including content depicting or facilitating illegal acts
• constitutes or contains child sexual abuse material (CSAM) in any form — such content will be removed immediately and reported to the relevant authorities and/or the National Center for Missing & Exploited Children (NCMEC) or equivalent body, as required by law
• contains hate speech, hate symbols, or content promoting discrimination, violence, or hostility against individuals or groups on the basis of a protected characteristic
• depicts graphic violence, gore, or self-harm, or is sexually explicit or pornographic
• infringes any third party's intellectual property, privacy, or publicity rights
• is misleading, fraudulent, or impersonates another business, brand, or individual without authorization (e.g., uploading a competitor's logo or a counterfeit brand mark); or
• otherwise violates this policy or any applicable law

Eazistamp reviews uploaded Content and reserves the right, at its sole discretion and without liability to you, to remove, disable, or refuse to publish any Content at any time, with or without notice, and to suspend or terminate your account for repeated or serious violations. Eazistamp's review of Content does not constitute an endorsement or guarantee that the Content is lawful, accurate, or free of third-party rights, and does not relieve you of your obligations and warranties above.

You agree to indemnify, defend, and hold harmless Eazistamp, its officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) Content you upload; (b) your breach of the representations and warranties above; or (c) any third-party claim that your Content infringes, misappropriates, or violates that party's rights.

Eazistamp provides a technical platform that allows businesses to upload, store, and display their own Content to their own customers, and acts as a hosting provider within the meaning of Regulation (EU) 2022/2065 (the Digital Services Act). Eazistamp does not select, initiate, or modify Content uploaded by businesses, and its review of Content under this section is provided on a best-efforts basis and does not constitute general monitoring or a guarantee of legality.

If you believe Content displayed on the Eazistamp platform is illegal or infringes your rights, you may submit a notice to legal@eazistamp.com describing the Content and its location, why it is illegal or infringing, your contact information, and a good-faith statement that the information is accurate. Eazistamp will acknowledge receipt and complete its initial review within 5 business days, except for manifestly illegal content (such as CSAM), which is escalated and removed immediately. If Eazistamp determines the Content violates this policy or applicable law, it will remove or disable access to it and notify the business that uploaded it, unless prohibited from doing so by law.

7. Intellectual Property

Eazistamp retains all intellectual property rights in the platform. You retain ownership of your branding assets (logo, colours) uploaded to the platform.

8. Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EAZISTAMP S.L.'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE 3 MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, CONSEQUENTIAL, OR LOSS-OF-PROFIT DAMAGES.

9. Termination

Either party may terminate with 30 days' written notice. We may suspend your account immediately for material breach, illegal activity, or non-payment beyond the grace period. On termination, your data is available for export for 30 days, then permanently deleted.

10. Governing Law

These terms are governed by Spanish law. Disputes shall be subject to the exclusive jurisdiction of the courts of Spain.
